Acceptance of Terms

By downloading, installing, or using SiblingSync, you agree to these Terms. If you do not agree, do not use the App.

Description of the Service

SiblingSync helps you organize family photos by child and provides local insights, such as Harmony or fairness-related metrics, based on what you choose to organize inside the App.

SiblingSync is designed to run primarily on-device without requiring a cloud account.

Eligibility

You must be legally capable of entering into these Terms. SiblingSync is intended for parents and guardians, not as a child-directed public posting service.

Your Responsibilities

• Use the App lawfully and responsibly.
• Maintain control of your device and understand that anyone with access to your unlocked device may access your local content unless you use device or app security features.
• Review the original photo warning above.
• Ensure you have rights to the photos you organize, for example your own photos or photos you have permission to use.

Photo Ownership and Rights

You retain ownership of your photos and content. These Terms do not transfer ownership of your photos to us.

SiblingSync may create local proxy or optimized images and store organization metadata on your device for functionality and performance. These proxies and metadata exist to support browsing, organizing, and exports you request.

Data Loss Disclaimer (Critical)

Because SiblingSync depends on your device's photo library and local storage:

• We are not responsible for loss of original photos due to deletion, device failure, operating system issues, third-party cloud service issues, or user action.
• We are not responsible for loss of exports if you delete or misplace ZIP export files after creating them.
• You are responsible for verifying your backups.

Acceptable Use

• Do not reverse engineer, decompile, or attempt to extract the source code of the App except where permitted by law.
• Do not use the App to violate others' privacy rights or intellectual property.
• Do not use the App in any way that could interfere with device security or the App's intended operation.

Termination

You may stop using the App at any time. We may suspend or terminate access to the App if required by law or if you violate these Terms.

Disclaimers

SiblingSync is provided "as is" and "as available." To the maximum extent permitted by law:

• We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee that the App will be uninterrupted or error-free.

Limitation of Liability

To the maximum extent permitted by law:

• Maksin Technologies LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of memories, data, or profits.
• Our total liability for any claim related to the App will not exceed the amount you paid for the App in the 12 months before the event giving rise to liability, or USD $0 if the App is free, unless applicable law requires otherwise.

Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles.
